2006 nissan maxima brake light and battery light flickering

I have a 2006 nissan maxima SL a couple months before summer i started
my car when it was a little cold outside my battery light and brake light came
on. They stayed on for a second then they started to flicker once the car is
warmed up the lights will stop flickering and wont come back on until the car
is fully cooled off. For context i have replaced Alternator and battery ive had
them both tested and tested good and alternator is charging at 14 volts. Im
looking for some insite to figure out what the issue is.

Check your brake fluid level. Asian vehicles tend to turn on both ALT and Brake lights when brake fluid gets low.

update, while its warming up it surges like the RPM gauge jumps up and down while the lights flicker, it also does it driving down the road which is new, could it be ECU?

Possibly, but you should do a live data scan so see if any sensors are out of specs or a showing a misread. You could also have grounding issues.
