Unless he installed a complete engine with all accessories I would say no.

Make a deal with him if he installed your old used pump. Buy the new one and he installs it free.

Only if a new water pump was installed at the same time the engine was installed. In my shop I always put on a new water pump when engines were replaced or overhauled, even on used engines.
