In my area the auto mechanic is reqired BY CONSUMER PROTECTION LAW to have you sign a pre work quote with a price and a complete explanation of what he is going to do. So it may depend on what you agreed to in writting. What kind of problem can't be fixed? There is a big difference between I don't know what I'm doing and can't fix it or even know where to look and here's what I think it is and it will cost you x. If you agreed to pay for a diagnosis and he could't give you one then I'd say drive home and let hin try to sue you.
