09 Jeep Wrangler transmission

My jeep was kicking out of first gear intermittently
and I have an extended warranty so I took it to
Aamco a transmission shop. The warranty company
had them tear it down to find a broken part and
they found gears and sychros chipped. Never had
any grinding or any other issue other than it kicking
out of first. Warranty company says the clutch
caused it and isn’t going to cover it. From my
understanding the clutch would have to be failing to
effect the synchros but I was wondering if anyone
had some input?

Parts fail, What they are really saying is you can not prove that you shifted gears perfectly everytime (a loop hole).
