Transmission shifting out of 1st gear

Just replaced new GM transmission
last summer. Has 3 year warranty.
Maybe once every 3 or 5 months from
a stop I accelerate and it stays in 1st
gear (3k) on tach. I let off pedal and it
engages in other gears which I think
might be 2nd? I discussed this with
dealership, said since this occurred so
infrequently not to worry about it,
probably a gletch. Since transmission
has been replaced this has happened
only a couple of times. I don't want
warranty to expire in the meantime.

I would inspect the motor and transmission mounts, they might be worn causing a bind in the driveline, and when you take your foot of the accelerator, it shifts because the engine drops back down in line with the transmission.
