Why does our 2012 FusionSEL 3.0 v6 seem jerky at lower speeds?

What is the cost to have the software upgrade, as we are past the 36000 warranty, or would it be covered under the 5 yr/60000 warranty?

Thank-you for your expert advise...the car dealer is upgrading the software at no charge. We forgot to ask if is O.K to continue to drive until we get it in next week....what do you suggest.
