2006 Jetta battery down and tail lights on

Why would my tail lights be on if battery dead

I had an older car than yours I think it was Honda: With the same problem. What I found was that there was a switch that was under my brake pedal: which I has to adjust. or change. "What happen was: When I press the brakes, the brake lights would come on. But some times that switch can go bad or jam. If it does go bad or stuck: When you take your feet of the petal the brake light stay on. So you adjust it, or change it.
