lemon law for buyer of used vehicles

Asked by kelleweston Dec 18, 2016 at 11:16 AM about the 2004 Mercedes-Benz E-Class E 320 4MATIC Wagon

Question type: Car Selling & Trading In

I have purchased a vehicle listed on your site that has proven to be unsafe and unfixable to this point. The dealer offered sale of the vehicle with no warranties. Are there any lemon laws that would help me to address the original dealer with misrepresentation of actual condition of vehicle?

Hi Kellerweston: As a former BBB Autoline arbitrator, the first place to start is with this link, https://www.ftc.gov/tips-advice/business-center/guidance/dealers-guide-used-car-rule and then the state the car was sold in. Unless the dealer didn't provide accurate information and comply with the appropriate jurisdiction's disclosure rules, you may be out of luck. Most likely, you will be dealing with the selling state's DMV at some point. It can be a long process, and you will need to document, document, document to have a chance of a favorable outcome. Be persistent, backed up by evidence, and you can prevail. Good Luck
