What constitutes a contract to sell?

Asked by Texhammer123 Apr 11, 2019 at 11:20 PM

Question type: General

One caller offered a price under the listing price, so I counter offered a higher
price.  There was no "acceptance" of the counter offer, only a discussion to
see the car for a test drive at an undetermined time.  A second offer came in
at the listing price so I agreed to that offer and will schedule a time for a test
drive. Can I assume neither prospective buyer has a contractual obligation
until an actual sale is processed through CarGurus?

This is not a legal forum but I would sell it to the first person who brings cash.
