cover on tow tool area

I bought a used 2010 Forester (at a Subaru dealer) the end of Sept and the plastic cover on the back bumper that covers the tow tool area was missing. I was told it would be taken care of while I was doing the paperwork. It wasn't. It's mid-Jan and I'm still fighting to get the part. My question is whether they have to have an explanation as to why they need the part. I'm wondering if it had been towed, the dealer knew about it even if it wasn't on the Carfax report.

Apparently in the 9 years that went by it fell off or it was taken off and lost. I would check with a Subaru dealer or look on Ebay for the part. Junk yards are another source. I don't think CarFax reports towing.
