How can the buyer drive the car home because I have to keep my tags?

The buyer can buy a temporary tag. Do NOT let the buyer use your license plates, they belong to you.

If the seller keeps the plates the car is still registered and insured , they can use one of their plates , what are the odds they get stopped ?

In my state the plates go with the car. Check with your DMV to know what the proper procedure is in your state.
